Welcome and thank you for your interest in Gooding & Company, LLC (“Gooding”) and the Site, as described in the Terms and Conditions. This Privacy Policy describes our policies and practices for handling your information. Capitalized terms used, but not defined, in this Privacy Policy have the meanings given to them in the Gooding’s Terms and Conditions (the “Terms”).

The Information Gooding Collects:

Information That You Provide To Us Directly: When using the Site, such as when you contact us, make a purchase, register for auctions, or submit absentee bids, you may provide Gooding with your information, including your driver license number, passport number, dealer or reseller license numbers, bank account numbers and branch information, credit card numbers, physical and electronic address, phone and fax numbers.

Information That We Collect Automatically: When you use the Site or open our emails, we may use cookies, “clear gifs,” “web beacons,” and similar technologies to automatically collect information from your web browser or device, including your Internet Protocol address, device identifiers, the type of web browser and device you use, your operating system, the web pages and sites that you visit just before or just after the Site, the pages you view on the Site, the dates and times that you use the Site, and other standard log information. For more information, please see the section below on “Cookies and Similar Technologies”. As explained below in “Your Choices,” you may be able to disable or otherwise control these technologies.

Information from Other Sources: We may also obtain information from third parties and sources other than the Site, such as your financial institution. If we combine or associate information from other sources (including, without limitation, from your Linked Accounts) with information that we collect through the Site, we will treat the combined information in accordance with this Privacy Policy, provided that if such third-party contract has additional requirements, we will be bound to adhere to such additional requirements.

The Way Gooding Uses Information:

The Site is highly personalized, and we use your information in a variety of ways and for a variety of reasons in the operation of our business, including:

  • Pursuant to our legitimate interests:

To operate, maintain, enhance, and provide all of the features and services found on the Site.

To prevent potentially prohibited or illegal activities and otherwise in accordance with our Terms of Use.

To understand and analyze the usage trends, interests, and preferences of our users, to improve the way the Site works and looks, and to create new features and functionality.

To monitor and analyze the effectiveness of Gooding and third-party marketing activities and aggregate usage metrics, such as total number of visitors or pages viewed.

To conclude corporate transactions (e.g., corporate restructuring, sale or assignment of assets, merger).

To protect our rights and property, enforce our Terms & Conditions and legal notices and for the establishment, exercise and defense of legal claims.

To ensure the security of your accounts, your personal information and our networks, including to prevent fraud and abuse.

To verify your identity before you create an account.

  • With your consent:

To personalize your experience of the Site. For example, when you log back in, we may welcome you back to the Site by name, present you with a customized user interface, or recommend features or content on the Site we think you may be interested in.

To send promotional emails, personalize our services, and deliver customized online advertisements, content, and information.

To verify available credit for purchases at the auction, including by contacting your financial institution and/or card issuer to verify account balances and available credit.

  • To provide you the service/fulfill contractual obligations:

To contact you for administrative, informational, or customer service purposes, such as to communicate with you regarding the status of your registration application, to notify you of changes to the Terms or to the details of an Auction (such as a modification to a listing in the catalog), or to follow up on registration or absentee bidder form submissions.

To track your entries, submissions, and status in any promotions or other activities.

  • To comply with our legal obligations, comply with compulsory legal process, such as a binding court judgement.

For any other purposes disclosed to you at the time we collect your information or pursuant to your consent.

When Gooding Discloses Information:

We are not in the business of selling your information. We do, however, need to disclose your information in the following circumstances in the ordinary course of operating our business.

Gooding works with third-party service providers who conduct website and application development, hosting, and maintenance as well as other services for us. To the extent it is necessary for these service providers to complete their contractual obligations to Gooding, these third parties may have access to or process your information. Auction Mobility provides our bidding platform services and will have access to and process your information. By using our Site and our services, you agree to the terms of Auction Mobility’s privacy policy at https://www.auctionmobility.com/platform-privacy-policy/. The Site allows you to link accounts with third-party services and push certain information regarding your use of the Site to such third-party service providers. The third-party operating the Linked Account will have access to your information for this purpose.

As noted above, Gooding may contact the bank you identify, or the issuer of your credit card, in order to verify that you have sufficient account balances and/or available credit for purchases at auctions, and in such cases Gooding will share your applicable information with such third parties to the extent reasonably necessary for the purposes of conducting such verification.

Gooding may make aggregated information available to third parties to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Site. Gooding may also disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws, or in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with investigative or law enforcement activity. Gooding also reserves the right to disclose information that we believe is appropriate or necessary to take precautions against liability; to protect Gooding and others from fraudulent, abusive, unlawful, or otherwise inappropriate uses or misuse of the Site; to investigate and defend ourselves against any third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Site; or to protect the rights, property, security, and/or safety of Gooding, our users, or others.

Gooding may share information for any other purposes disclosed to you at the time we collect the information or pursuant to your consent.

Cookies and Similar Technologies:

We use cookies on our Site. A cookie is a text file containing small amounts of information that is downloaded on your device’s storage mechanism when you access a webpage on the Site, and that can subsequently be accessed by our web servers.

We use session cookies and persistent cookies. Session cookies are temporary. They allow us to link your actions on the Site from the moment you open the browser window until you close the browser window. Once you close the browser, all session cookies are deleted. Persistent cookies remain on your device for a set period of time specified in the cookie. They are activated each time you visit the Site.

We also use pixel tags/web beacons on our Site. A pixel tag (also known as a web beacon) is a piece of code embedded on the Site that collects information about your engagement on that web page. The use of a pixel allows us to record, for example, that you have visited a particular web page or clicked on a particular advertisement.

These technologies automatically track and collect certain technical information that your computer or device, such as your IP addresses, date and time of activity on our Site, browser types, browser language, referring and exit pages, URLs, location information, session ID, platform type, details on the mobile device used and ID, operating system, the number of clicks, domain names, landing pages, clickstream data, pages viewed and the order of those pages, the amount of time spent on particular pages, log-in/authentication details and other similar information.

We use cookies and similar technologies for a variety of reasons (as mentioned in the section above called “The Way Gooding Uses Information”), including to: (i) provide you with the service requested and for the Site to function; (ii) allow us to remember your preferences and information provided in contact forms (e.g., for future visits to the Site); (iii) allow you to securely and more easily login to our Site; (iv) to recognize you as a previous visitor; (v) analyze the usage of our Site; (vi) provide a more personalized experience; (vii) manage advertising; (viii) help make your use of our Site more efficient and more valuable by providing you with a customized experience and recognizing you when you return.

We allow third parties, including business partners, advertising networks, and other advertising service providers, to collect information about your online activities through cookies, pixels, and other technologies. These third parties may use this information to display advertisements on the Site and elsewhere online tailored to your interests, preferences, and characteristics. Your interactions with these features are governed by the privacy policy of the company providing it. The Site may contain links to content maintained by third parties that we do not control. We are not responsible for the privacy practices of these third parties, and the information practices of these third parties are not covered by this Privacy Policy.

Do-Not-Track Signals and Similar Mechanisms:

Some web browsers transmit “do-not-track” signals to websites. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

Your Choices:

You may, of course, decline to share certain information with Gooding, in which case Gooding may not be able to provide to you some of the features and functionality found on the Site. You may update, correct, or delete your profile information and preferences at any time by accessing your account preferences page through the Site. Please note that while your changes may be reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics. If you want us to also delete the information from our systems, please contact us as described below.

If you are located in the EU or UK, you may be able to restrict or object to our processing of your data, and to request access to your data, as well as exercise other rights, such as a right to delete or port your data. If you have given us your consent for a particular processing operation, you can withdraw such consent at any time. If you are located in the EU or UK, you also have the right to lodge a complaint with a data protection authority.

To protect your privacy and security, we take steps to verify your identity before granting you account access or making corrections to your information.

You may be able to disable or block cookies and similar technologies. Please review your web browser “Help” section to learn how to change your cookie settings and similar controls. Please note that if you delete, or choose not to accept, cookies from the Site, you may not be able to utilize the features of the Site to their fullest potential.

You may opt-out of receiving commercial messages from us by updating your account settings through the Site or unsubscribing as instructed in the message.

Retention of Information:

We only retain the information we collect as long as reasonably necessary for the purposes set out above or as required by law.

Data Security:

Gooding uses certain physical, managerial, and technical safeguards designed to help improve the integrity and security of your information. Nevertheless, no physical or technical system, process, transmission, or storage mechanism is completely secure or immune from outages, losses, attacks, circumvention, design or implementation flaws, and human error.

International Visitors:

The Site is provided to you by Gooding & Company, LLC based in the United States. To the extent you are a resident of a country other than the United States, you understand that by using the Services and providing us with information your information may be transferred to and stored on servers located outside your resident jurisdiction. Laws in these other jurisdictions may differ from, and may not provide a level of data privacy and security equivalent to the laws in your country. However, we will handle your personal information in accordance with this Privacy Policy and applicable law regardless of where we transfer, store, process, or access such information.

Changes and Updates to this Privacy Policy:
